These Terms of Use (“Terms”) govern your access to and use of eastidaho-events.com and related services provided by East Idaho Events, LLC (collectively, the “Services”). By using the Services, you agree to these Terms and our Privacy Policy.
1. Platform Nature; No Endorsement or Hosting
East Idaho Events, LLC operates a listings and promotional platform. We do not host, produce, operate, or control any events listed by users or organizers. Listings are for informational purposes only and do not constitute endorsement or verification.
2. Critical Disclaimer & Assumption of Risk. This release does not apply to liability resulting from gross negligence or willful misconduct, or to any rights that cannot be waived under applicable law.
YOU UNDERSTAND AND AGREE THAT ATTENDING ANY EVENT INVOLVES INHERENT RISKS. YOU ASSUME ALL RISKS, KNOWN AND UNKNOWN, ASSOCIATED WITH ATTENDANCE OR PARTICIPATION IN ANY EVENT LISTED ON THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AND DISCHARGE THE COMPANY FROM ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO ANY EVENT, INCLUDING PERSONAL INJURY, ILLNESS, PROPERTY DAMAGE, AND ECONOMIC LOSS.
By posting an event or using outbound links (e.g., to ticketing providers), you acknowledge and agree to this assumption of risk and release.
3. No Duty to Monitor; Editorial Discretion
We may, but have no obligation, to monitor, screen, edit, or verify listings or user content. Exercising editorial discretion does not create any duty to monitor, and no such duty is assumed. We may remove or refuse any content for any reason or no reason.
4. Organizer Terms (Additional Obligations)
If you post or manage listings (“Organizer”), you represent and warrant that: - You hold and will maintain all permits, licenses, and authorizations required for your event. - You will maintain commercial general liability insurance (and liquor liability if applicable) and, upon request, provide a certificate of insurance. - Your listing is accurate, not misleading, and will be promptly updated for changes or cancellations. - You will post clear refund/cancellation terms and an Organizer contact method. - You will comply with all applicable laws, venue rules, and safety requirements, including ADA. - You will indemnify, defend, and hold harmless the Company from claims arising out of or related to your events, listings, or negligence/misconduct.
5. User Content & License
You retain ownership of your content. You grant us a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, display, and distribute your content solely to operate and promote the Services. You represent and warrant you have all necessary rights to submit content and that it does not infringe others’ rights.
6. Transactions with Third Parties
Ticketing and purchases occur on third‑party platforms and are solely between you and the organizer or provider. We are not a party to those transactions and are not responsible for refunds, chargebacks, or disputes.
7. Prohibited Conduct
You will not: (a) post unlawful, unsafe, infringing, deceptive, or fraudulent content; (b) impersonate others or misrepresent affiliation; (c) scrape or interfere with the Services; (d) attempt to bypass security or access non‑public areas; (e) use the Services to advertise illegal events.
8. Abuse & Fraud Reporting
Report suspected fraud, safety issues, or policy violations to [email protected]. We may suspend listings or accounts pending investigation.
9. Intellectual Property; DMCA
The Services and all materials we provide (excluding user content) are owned by us or our licensors and are protected by IP laws. If you believe your copyright has been infringed, send a notice to our DMCA Agent including the information required by 17 U.S.C. §512.

10. Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE OR COMPLETE OR THAT EVENTS WILL OCCUR AS DESCRIBED.
11. Limitation of Liability
Arbitration; Class Action Waiver
Except for claims that may be brought individually in small-claims court, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this agreement to arbitrate. Arbitration will take place in Boise, Idaho, unless you and we agree otherwise or the arbitrator determines a remote hearing is appropriate. You and Company each waive the right to a jury trial. YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. This clause does not prevent the parties from seeking interim injunctive relief in a court of competent jurisdiction. You may opt out of this arbitration agreement by sending a written opt‑out notice to [[email protected]] within 30 days after you first accept these Terms.
Force Majeure
Company will not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including acts of God, natural disasters, epidemic or pandemic, labor disputes, governmental actions, acts of terror or war, internet or telecommunications failures, or utility outages.
Changes to the Services
We may modify, suspend, or discontinue all or part of the Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may freely assign or transfer these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.
Notices

Notices are deemed received (i) three business days after mailing by certified mail (return receipt), (ii) one business day after confirmed overnight courier delivery, or (iii) when sent by email with confirmation of transmission. We may provide operational notices to you via the Services, email, or your account contact details.
Prohibited Content and Activities
In addition to any other restrictions in these Terms, the following content and activities are prohibited on or through the Services. We may remove content or listings and suspend or terminate access for violations.
Organizer Insurance; Proof and Enforcement
Where the nature of an event warrants, organizers must maintain appropriate insurance (e.g., general liability, liquor liability where alcohol is served) and, upon request, provide a current certificate of insurance (COI) naming East Idaho Events, LLC as an additional insured where commercially reasonable. Company may require a current COI as a condition to posting or continuing a listing and may suspend or remove a listing for failure to provide or maintain such coverage.
Organizer Refund Terms
Organizers must clearly disclose refund and cancellation terms applicable to their events. We may require organizers to post such terms as a condition to listing and may remove or suspend listings that omit refund terms or violate applicable consumer‑protection laws.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the Services or violation of these Terms. Organizers’ obligations are in addition to this section.
13. Dispute Resolution
Before filing suit or arbitration, the parties will attempt to resolve disputes informally for 30 days. Either party may bring individual claims in small claims court in Bonneville County, Idaho. If you and we agree to arbitrate a dispute, it will be conducted on an individual basis under the AAA Consumer/Commercial Rules, with a delegation clause and fee rules consistent with those procedures. Nothing limits either party’s ability to seek injunctive relief for IP or misuse of the Services.
14. Governing Law; Venue
These Terms are governed by the laws of the State of Idaho without regard to conflicts principles. Exclusive venue and jurisdiction lie in the state courts located in Bonneville County, Idaho and the U.S. District Court for the District of Idaho, as applicable.
15. Termination
We may suspend or terminate access to the Services at any time with or without notice for any reason.
16. Changes
We may update these Terms from time to time. The “Last updated” date reflects the latest changes. Continued use after changes constitutes acceptance.
17. Miscellaneous
These Terms constitute the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remainder will remain in effect. No waiver is effective unless in writing. You may not assign these Terms without our consent.
